Surfing can be an enjoyable and exciting activity. However, like many recreational activities that require physical exertion, surfing carries with it the risk of physical injury. The risks associated with surfing include the following:
you may be exposed to cold water (and possibly polluted water) and the sun for a long period of time;
you will be physically exerting yourself in ways you may or may not be accustomed;
choosing to ride a board that does not suit the conditions or your skill level;
you may collide with another surfer (or other ocean-user) or his or her (or your own) board;
you may collide with some other water-craft (including being run over by a jet ski or boat (including if it gets caught by a breaking wave));
you may lose your balance and fall from your board onto a shallow sandbank or reef;
you may be dumped by a wave onto a shallow sandbank or reef;
you may be caught in a rip and dragged out to sea or into an area where the waves are breaking with high impact or onto rocks or a headland;
traveling to, along and from the surfing venue;
you may be exposed to rapid and adverse changes in weather, ocean and wave conditions; and/or
you may be stung or bitten by an ocean creature, such as a bluebottle jellyfish, stingray or shark,
and as a result you may aggravate an existing injury (especially shoulder injuries) or suffer serious injury, disease or death (including by drowning).

You should ensure that you wear an appropriate wetsuit or rash shirt (in the hotter months), apply maximum protection sun-block cream on all exposed skin, keep your legrope attached to you and your board at all times and never surf alone.

By participating in surfing activities and/or equipment provided by Surf Rotation Pty Ltd (ACN 681 767 126), its related bodies corporate and any other person in conjunction with whom they hire equipment to you (such as a youth hostel or hotel) or provide any services (Surf Rotation) either at this time or in the future, you agree:
to comply promptly with all directions given to you by Surf Rotation or any of its employees or agents or by any surf lifesavers on duty where you choose to surf;
that you surf and use Surf Rotation’s board at your own risk;
that the agreement for goods or services provided to you by Surf Rotation hereby to the maximum extent permitted by law totally excludes any liability that results from breach of any implied or express warranty that the goods or services of Surf Rotation are of acceptable quality or will be rendered with due care and skill and excludes any implied or express warranty and any liability for their breach that any equipment provided by Surf Rotation in connection with the surfing activities or separately will be fit for the purpose for which they are supplied;
Surf Rotation has no liability to you for personal injury, disease or death arising from the services and/or equipment that Surf Rotation provides to you;
to irrevocably and unconditionally releases and forever discharges Surf Rotation and its officers, employees and agents from all present and future claims (including claims in contract, tort or statute) which you may have against them; and
acknowledges that Surf Rotation may plead this risk warning, release and exclusion of legal liability as a bar to any claim or proceeding that arises out of or relates to any matter referred to in it.

If a court determines that any part of this risk warning, release and exclusion of legal liability is invalid or unenforceable then they are to be severed from the rest and all other parts are to be given full legal force and effect.
